Terms of Service

1. Acceptance of terms

By creating an account and using PongoNotes, you agree to these Terms of Service. If you do not agree, do not use the service. PongoNotes reserves the right to update these terms at any time; continued use constitutes acceptance.

2. The service

PongoNotes is a note-taking application operated and hosted by PongoNotes. The service allows you to create, organize, and manage personal notes, folders, tags, and file attachments.

3. Your account

You are responsible for maintaining the security of your account credentials. Do not share your password. You are responsible for all activity that occurs under your account. Contact us immediately via the Support page if you suspect unauthorized access.

4. Acceptable use

You agree not to use PongoNotes to:

PongoNotes may suspend or delete accounts that violate these terms without notice.

5. Your content

You retain full ownership of the notes and files you create. PongoNotes does not access, read, or use your content for any purpose other than operating the service (e.g. performing backups or maintenance). Your content is not shared with any third party.

6. Data and privacy

Use of this service is also governed by the Privacy Policy, which describes how personal data is collected, used, and protected.

7. Service availability

PongoNotes is provided on a best-effort basis. We make no guarantee of uptime, data durability, or continued availability. It is your responsibility to export and back up your own data regularly using the Profile → Export my data feature.

8. Limitation of liability

PongoNotes is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, PongoNotes shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of data, loss of profits, loss of goodwill, or loss of access, arising from your use of or inability to use this service. This includes damages resulting from security incidents, unauthorized access, or data breaches, even where reasonable security measures were in place. You acknowledge that it is your responsibility to maintain independent backups of your data using the Profile → Export my data feature.

In any case where liability cannot be fully excluded by law, the total aggregate liability of PongoNotes to you for all claims arising out of or relating to these terms or the service shall not exceed fifty euros (€50) or the total amount you have paid to PongoNotes in the twelve months preceding the claim, whichever is greater.

9. Indemnification

You agree to defend, indemnify, and hold harmless PongoNotes and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the service; (b) content you store in the service; (c) your violation of these Terms of Service; or (d) your violation of any applicable law or the rights of any third party.

10. Termination

You may delete your account at any time via Profile → Delete Account. PongoNotes may also terminate or suspend access at its discretion. Upon account deletion, all your data is permanently removed.

11. Force majeure

PongoNotes shall not be liable for any failure or delay in performing its obligations where such failure or delay results from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, government action, power outages, internet infrastructure failures, denial-of-service attacks, or security breaches carried out by third parties despite reasonable precautions.

12. Governing law

These Terms of Service are governed by and construed in accordance with the laws of Sweden. Any disputes arising from or related to these terms or your use of PongoNotes shall be subject to the exclusive jurisdiction of the Swedish courts.
